Protecting Your Assets is Our Priority

We work with individuals, couples or adult children on behalf of their parents to assess Medicaid (MO HealthNet in Missouri) eligibility for the person in need of care. We also design and create Medicaid Asset Protection Plans to help them meet Medicaid eligibility requirements while preserving as much of their assets as the law permits

Generally, there are two different types of Medicaid planning: planning in advance and crisis planning. Crisis planning refers to what assets can be protected after a person has already entered a nursing home.

MO HealthNet has a 5-year look-back period, in order to protect all of your assets from being spent on nursing home care those assets would have to be transferred out of a person’s name or into an Irrevocable Medicaid Asset Protection Trust 5 years prior to entering a nursing home.

Asset protection is a primary component of financial planning. This must also be done within the bounds of debtor-creditor law without engaging in the illegal practices of concealment (hiding of the assets), contempt, fraudulent transfer (as defined in the 1984 Uniform Fraudulent Transfer Act), tax evasion, or bankruptcy fraud.

How Can We Save the Family Farm?

One of the most cherished assets for many families is the family farm, which holds deep sentimental and cultural value. While preserving the family farm for future generations is a top priority, some families also seek to protect their farm from being used to fund their retirement or long-term care expenses. For many families, transferring ownership of the family farm to an Irrevocable Medicaid Asset Protection Trust is a viable solution that can achieve both goals.

However, it’s important to keep in mind that the transfer of ownership to the trust must occur at least five years prior to the owner’s application for nursing home Medicaid benefits. This five-year waiting period is an important consideration when planning ahead for asset protection, especially when it comes to a valuable and sentimental asset like the family farm.

The good news is that many families find peace of mind in the thought of transferring ownership of their family farm to a trust, knowing that it will be protected for future generations. They do not view the farm as a personal asset and instead see it as a legacy to be passed down to future generations.

It’s crucial to work with an experienced Elder Law attorney to ensure that the transfer of ownership and the creation of the trust are done correctly, and that all the legal requirements are met. An Elder Law attorney can also help families anticipate and address any potential issues that may arise in the future, giving them peace of mind and the security they need to protect their family farm for years to come.

Do You Need An Elder Law or Asset Protection Lawyer?

An Elder Law attorney’s job is to increase the quality of life of their clients, not just figure out who-gets-what after they pass away.

Asset protection lawyers are legal professionals who specialize in helping individuals and businesses protect their assets from potential creditors, lawsuits, and other risks. They can advise you on the legal strategies that are best suited to your specific situation and help you create a comprehensive asset protection plan that meets your needs.

In addition to helping clients plan ahead, an Elder Law lawyer can also help those in emergency situations. If a loved one suffers from an unexpected illness or injury, it may be necessary to make quick changes to determine how to pay for care.

An asset protection plan can help protect your money and make sure your family is safe financially.

Lawsuits can be expensive and ruin your finances. An asset protection plan can lower the chance of that happening by keeping your assets safe from lawsuits.

If you own a business, an asset protection plan can keep your business assets and personal assets separate. This way, if something happens to your business, it won’t hurt your personal finances.

Lastly, an asset protection plan can help with estate planning. This means that you can choose who gets your money and how much they get after you pass away. It can also help save money on taxes.

Elder Law attorneys advocate for older adults and disabled people by handling different legal matters such health care expenses; long-term healthcare planning issues; guardianship arrangements; retirement plans/benefits and Medicare/Medicaid.
